If the hearing officer determines that you must leave the apartment (terminates your tenancy), NYCHA will then begin a holdover case against you in Housing Court. The judge in Housing Court cannot listen to the facts of the case to determine if you can stay or not. He or she will only have the power to enforce the decision from the termination hearing. The judge can give you time to get a decision from the Supreme Court if you challenged the termination decision with an Article 78.
