The first step in a NYCHA holdover case is a termination of tenancy proceeding. (There are some cases that start in Housing Court first – those are unusual and tenants in these cases should seek legal help.) Tenants are notified of the charges against them and required to appear at a hearing. The hearings are held at 250 Broadway in Manhattan. Most of these cases are settled with an agreement and do not go to Housing Court. However, if there is a full hearing with a decision, that decision can only be challenged by filing a special case, called an Article 78 Proceeding, in the State Supreme Court.
